Aiko Terms of Service

DRAFT — for attorney review before publication. Bracketed items are decisions still to be made. Do not publish with brackets in it.

Effective date: [date]
Provider: [Legal entity name — currently Branden Greene, sole proprietor] ("Aiko", "we").

By creating an account, installing the Aiko Chrome extension, or using aikoapply.com, you agree to these terms and to the Privacy Policy at https://aikoapply.com/privacy.

1. What Aiko does

Aiko finds job postings that match your résumé, prepares applications by answering employer forms from your résumé and profile, and submits those applications to employers when you authorize it. Some steps run on our servers; for certain employer systems the final submission runs in your own browser through the Aiko Chrome extension. Aiko is a tool that acts on your instructions. It is not a recruiter, staffing agency, employer or career adviser.

2. Eligibility

You must be at least 18 and legally able to work in the jobs you apply to, or applying in good faith to learn whether you are. One account per person. You may not use Aiko on behalf of someone else without their knowledge and consent.

3. Your information must be true

Every answer Aiko enters comes from the résumé and profile you provide. You are responsible for their accuracy. Aiko never invents experience, qualifications, credentials or personal characteristics; when it cannot answer a question truthfully from what you gave it, it leaves the question for you. If your résumé or profile is false, the applications will be false, and that is on you. Keep them current.

4. What you authorize

When you click Auto Apply on a posting, or enable a setting that applies to matching postings automatically [remove if no such setting ships], you authorize Aiko to prepare and submit that application on your behalf, including entering your voluntary self-identification answers where an employer asks for them and, if you have enabled it, reading the verification code an employer emails you. Each submission is made at your direction; Aiko is your agent for that act. You can review prepared applications before submission and can stop any application that has not been submitted.

If you turn on "Track replies to my applications" in the Chrome extension, you also authorize it to read the sender, subject and preview line of mail in your own Gmail, and to search your Gmail for the employers you applied to, in your own browser, in order to notice replies to applications you submitted through Aiko, and to send your Aiko account the status it worked out and a link to the message. It is off unless you turn it on. The status is worked out by simple rules and can be wrong; it is a convenience, not a record of what an employer decided, and you should read the email itself before acting on it.

You can revoke the extension's access to your Gmail at any time by disabling these features or removing the extension.

5. Third-party sites and their rules

Applications are submitted to employer systems operated by others (for example Greenhouse, Lever, Ashby, Workable, Paylocity). Their terms govern your relationship with them. Some employer systems discourage or limit automated submission. Aiko submits truthful applications from a real person and, where a site requires it, from your own browser; it never solves a CAPTCHA puzzle for you and never fakes an identity. Even so, an employer or platform may reject, flag or limit applications it believes were automated, and that is a risk you accept by using Aiko. We will tell you what we know about a platform's stance when we know it.

6. No guarantee of outcomes

Aiko does not promise interviews, offers or employment, does not promise that any application will be accepted or reach a human, and does not promise that every question on every form can be answered automatically. Job-match rankings are estimates.

7. Fees

[Aiko is free during beta.] [Describe pricing, billing, cancellation and refunds if any.]

8. Acceptable use

You will not use Aiko to apply for jobs you have no intention of taking, to submit false information, to harass employers, to apply on behalf of others without consent, to probe or overload employer systems, or to reverse engineer, resell or interfere with the service. We may rate-limit or suspend accounts that do.

9. Your content and our service

You keep all rights to your résumé and answers. You give us the limited license needed to store, process and submit them as described in the Privacy Policy. Aiko, its software, the extension and the aikoapply.com site are ours; you get a personal, revocable, non-transferable right to use them under these terms.

10. Disclaimers

Aiko is provided "as is" and "as available". To the fullest extent the law allows, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose and non-infringement. We do not warrant that the service will be uninterrupted, error-free or that any application will be delivered or answered correctly.

11. Limitation of liability

To the fullest extent the law allows, Aiko and its owners are not liable for indirect, incidental, special, consequential or punitive damages, or for lost opportunities, lost income or lost employment, arising from your use of Aiko. Our total liability for any claim is limited to the greater of the amount you paid us in the twelve months before the claim or [US $100]. Some jurisdictions do not allow these limits; where they do not, they apply to the extent permitted.

12. Indemnity

You will defend and indemnify Aiko against claims arising from false information you provided, your violation of these terms, or your violation of a third party's rights.

13. Termination

You can stop using Aiko and delete your account at any time. We can suspend or end your access for violating these terms or if we discontinue the service, with notice where practical. Sections 3, 9 through 14 survive termination.

14. Governing law and disputes

These terms are governed by the laws of the State of California, without regard to conflict-of- law rules. [Attorney: choose between (a) courts of [county], California, and (b) binding arbitration with a small-claims carve-out and class-action waiver. Add the required opt-out language if (b).]

15. Changes

We may update these terms. Material changes will be announced by email or in the app before they take effect. Continued use after that is acceptance.
